Business Concerns Rejected by Senate Committees;

Guns Bills Move Ahead

IMMEDIATE ACTION NEEDED
CALL HOUSE AND SENATE MEMBERS TODAY

       Senate committee members have advanced two bills (SB 2992 and SB 3002) that ignore property rights of employers, that ignore safety responsibilities of employers and that create a new protected class of employees with rights to sue for economic and non-economic damages.  Companion bills are on the calendar in a House subcommittee.  The NRA is pushing hard for these bills and legislators are hearing from them daily.

       THEY NEED TO HEAR FROM YOU!
       Call today and tell them:
  • Private property rights must be protected.
  • Employers must provide a safe environment for employees, customers and guests.
  • The bills don’t limit the number or types of firearms a person can have in their vehicle.
  • A new protected class of citizens with a risk for more and bigger law suits is a JOBS KILLER.

       Senate Commerce and Judiciary committees soundly rejected the concerns and rights of the business community and public and private employers when two NRA bills expanding gun rights over property rights were passed and sent to the Senate floor.
       SB 3002, which forbids most private property owners from restricting guns on their property, was amended and passed out of Senate Judiciary on a 6-1 vote with two senators present and not voting.  The amended bill, touted by sponsors as a “compromise”, reflected no input or conversations with the business community.  Voting for the bill were Senators Barnes, Beavers, Bell, Campfield, Overbey and Yager.  Senator Marrero was the lone “no” vote and Senators Ford and Kelsey were present but didn’t vote.  The amended bill ignores private property rights and creates safety issues for every employer or property owner.
       Specifically, the amendments narrow the right to have a firearm or multiple firearms of any type locked in a vehicle to anyone who has a handgun carry permit or who is over 21 with a hunting license.  They also restrict them from being on an owner-occupied or tenant-occupied single family detached residence, a licensed nuclear power facility or a national laboratory.  Hospitals, schools and universities, day care centers, apartment complexes, shopping centers, manufacturing facilities, transportation facilities and employers of all sizes and types were denied the right to manage their private property.
       Related action by the Senate Commerce Committee in passing SB 2992 as amended will basically prevent any public or private employer from enforcing allowable rules or of even knowing whether an employee or applicant either has a hunting license or carry permit.  This new “protected class” of employee or applicant is given full rights to bring suits for both economic and non-economic damages.  The amended bill passed on a 6-3 vote with Senators Beavers, Faulk, Gresham, Johnson, Southerland and Tracy voting “yes” and Senators Burks, Stewart and Tate voting “no.”
       The bills could be on the Senate floor as soon as Monday night.
       Lt. Gov. Ron Ramsey today said that the bills eliminating the rights of businesses and schools to block people from storing guns in locked vehicles on their parking lots “go too far.”  He told reporters he considers himself “the biggest Second Amendment rights person that’s ever lived,” adding that he was the sponsor of the original handgun-carry permit law.  The current guns right’s bill only need to apply to handgun permit holders, he said, adding , “And I’m still one that [thinks] there should be some form of posting, I’ve still not settled on exactly what yet, that allows certain businesses to post [against guns on] their parking lot.”
       Four House bills – two companion bills to the Senate bills by Rep. Eddie Bass and two other ones by Rep. McCormick and Rep. Evans – are the last four bills on the published calendar for House Consumer & Employee Affair subcommittee next Wednesday. 
 
Mountaintop Removal Heads to Summer Study

       A second round of targeted television ads from the Tennessee Conservation Voters weren’t enough to swing the votes that environmentalists wanted to stop mountaintop surface mining in Tennessee.  Instead, members of the House Conservation Subcommittee sent HB 291 to summer study on a 6-4 vote.   The Senate version, SB 577 – amended in committee to be business acceptable – is on the Senate floor. 

Sales Tax Nexus Bill Now Law

       Gov. Bill Haslam signed HB 2370 into law last week, requiring Amazon to collect sales tax by 2014. The new law will ensure that Amazon will pay Tennessee sales tax if federal leaders don't approve a national online sales tax law by 2014.  Many bricks-and-mortar retailers were unhappy about the three-year hiatus, saying it gives Amazon a “huge” edge.   
 
Pace Picks Up; Early Adjournment Hopes Rise
       With all but four Senate committees closed, subject to the call of the chair, and House Committees moving toward closure or last calendar, prognosticators are beginning to whisper about an earlier-than-usual adjournment date.   With the budget scheduled for House Finance subcommittee next week, it could see House floor action in as soon as two weeks.  Several administration bills are moving, filing date is looming and patience is wearing thin.  For some, it is a sure sign it is time to start getting ready to go home!
